Licence terms

These terms govern every download made from this site, free or paid. They are the reference document for the “license” property published in the structured data of each photo page.

1. Definitions

The Licensor means Nom Prénom, author and exclusive owner of the economic rights in all photographs published on Photos Réunion. The Licensee means the individual or legal entity downloading an Image. The Image means any photographic file made available, at any resolution. The Preview means the watermarked 1200-pixel-wide file. The Clean Preview means the same 1200-pixel file without watermark. The High-Resolution File means the file at its native resolution, without watermark. The End Client means a third party on whose behalf the Licensee carries out work.

2. Ownership

All Images are the work of a single author. The Licensor warrants that it holds all rights necessary to grant the licences described below, subject to the restrictions expressly stated on each Image page. No assignment of copyright is granted: the Licensee receives a licence to use, not a transfer of ownership.

3. Preview licence, free of charge

Downloading the watermarked Preview is free. It grants a non-exclusive, worldwide licence for the legal term of protection, subject to all of the following conditions:

  • non-commercial use only: personal, educational, not-for-profit, or illustration of unsponsored editorial content;
  • mandatory credit, visible immediately next to the Image, in the form “Nom Prénom / Photos Réunion”, including an active link to https://photosreunion.re wherever the medium allows;
  • watermark preserved: any removal, reduction, crop intended to eliminate it, or automated processing aimed at removing it is prohibited and constitutes infringement;
  • no redistribution of the Preview as such, in particular on a stock library, a file repository or a machine-learning training dataset.

3a. Clean Preview licence, free account

Creating a free account gives access to the Clean Preview: the same 1200-pixel frame, without the watermark. The terms of the Preview licence apply in full, with one exception: the obligation to preserve the watermark no longer applies.

Use remains strictly non-commercial and credit remains required. Removing the watermark grants no commercial right: it is a layout convenience, not a change of licence. Commercial use requires a Studio, Agency or single-image licence, whatever resolution is used.

4. Studio licence

Granted to Studio subscribers, for the duration of the subscription and perpetually for Images downloaded during that period. It is non-exclusive, worldwide, non-transferable, and permits:

  • digital commercial use with no volume limit: website, social media, email, online advertising, sales material;
  • printing up to 10,000 copies in total per Image, across all media;
  • modification, cropping and incorporation into a composite work;
  • use without credit, which remains appreciated but is not required;
  • downloading the Images within the monthly volume subscribed, with any unused balance carried over to the following month. Images already downloaded remain licensed in perpetuity, including after cancellation.

Beyond 10,000 copies, and for any outdoor display, the Print Advertising licence of clause 6a is required.

It does not permit use for the benefit of an End Client. An agency, studio or freelancer producing material on behalf of a third party requires the Agency licence.

5. Agency licence

The Agency licence includes all rights granted under the Studio licence and expressly adds:

The right to use the Images in work carried out on behalf of End Clients, and to transfer to each End Client a perpetual, non-exclusive, worldwide right of use over the Images incorporated in the deliverable supplied to them.

This clause addresses the concrete case of the web designer, communication agency or design studio delivering a website, an identity or a campaign to a client. The End Client may continue to exploit the Images incorporated in the deliverable even after the relationship with the Licensee ends, and even after the Agency subscription is cancelled.

Limits of the transfer to the End Client:

  • it covers only Images actually incorporated in an identified deliverable;
  • it does not allow the End Client to redistribute the Images to third parties, nor to exploit them outside the deliverable;
  • it does not give the End Client any right to download further Images.

On request, the Licensor issues the Licensee a named licence certificate stating the End Client and the list of Images concerned.

6. Single-image licence

Per-image purchase, without subscription. Grants a perpetual, worldwide, non-exclusive and non-transferable commercial licence over one specified Image, on the same terms as the Studio licence. Transfer to an End Client is not included; it may be obtained by purchasing an Agency licence.

6a. Print Advertising licence

An extended licence which combines with a Studio, Agency or single-image licence rather than replacing it. It lifts the print run limit and opens outdoor display:

  • unlimited print run in print and press, all formats;
  • outdoor advertising: billboards, bus shelters, street furniture, signage, vehicle wraps, construction hoardings;
  • packaging, point-of-sale and in-store material;
  • indoor display: cinema, trade shows, exhibition stands.

It remains subject to the restrictions in clause 7. In particular, the Image may not become the principal element of a product sold for its own sake: an advertising poster for a hotel falls under this licence, a decorative poster sold in a shop does not.

Basis of the fee

The fee is calculated per 4×3 face displayed, not per Image. Two faces in the same campaign count as two; one Image running across four sites counts as four. Formats other than the 4×3 are converted to a face-equivalent stated in the quote.

An outdoor campaign exposes a photograph to an audience on an entirely different scale from a website, and ties it lastingly to a brand. That is why it is counted by exposure rather than by file.

Formation of the contract

This licence is not issued self-service. It is formed in four steps:

  1. Request, the Licensee states the Images chosen, the number of faces, the display period and the geographical area;
  2. Quote, the Licensor issues a named quote, priced at the per-face-displayed rate, valid for thirty days;
  3. Author’s approval, the Licensor approves or declines the campaign. They may decline without giving reasons, in particular where the message, the advertiser or the context appears incompatible with the subject depicted or with their moral rights. No payment is called for before this approval;
  4. Electronic acceptance, the Licensee accepts the quote online. That acceptance, timestamped and retained, stands as a signature under article 1367 of the French Civil Code and forms the contract.

The licence takes effect on acceptance, for the duration and scope set out in the quote. Any extension, additional face or wider area requires a new quote.

7. Restrictions applying to all licences

Under every licence, it is prohibited to:

  • resell, sub-license, rent or redistribute an Image as a file, including within a template or theme intended for multiple resale;
  • use an Image as the principal element of a derivative product intended for resale: print, poster, postcard, textile, phone case, canvas;
  • register an Image, or a work derived from it, as a trade mark, logo or design;
  • use an Image in a defamatory, pornographic or discriminatory context, or in any way liable to harm the reputation of the people, places or property depicted;
  • include an Image in a machine-learning training dataset, or use it to generate content by AI, without the Licensor’s prior written agreement;
  • leave a High-Resolution File or Clean Preview accessible at an unprotected public URL, in particular an open directory or a public code repository.

8. Editorial-only Images

Some Images are marked “editorial use only” on their page. They do not carry all the clearances required for commercial use, either because an identifiable person appears without a signed release, or because a location or property requiring a shooting permit has not granted one.

These Images are excluded from Studio, Agency and single-image downloads. They may only illustrate informational or news content, unconnected with the promotion of a product, service or organisation. A Licensee using them outside that scope bears sole responsibility for the consequences.

9. People and property depicted

Images for which a model release has been obtained are recorded as such in the Licensor’s internal catalogue. The Licensee nevertheless remains responsible for checking that the intended use complies with applicable local law, particularly for sensitive uses: health, political opinion, sexual orientation, criminal convictions.

10. Term and termination

Studio and Agency licences are granted for the duration of the subscription. Rights acquired over Images downloaded during that period survive its end. Termination ends the right to download further Images, not the right to exploit those already downloaded.

The Licensor may terminate a Licensee’s licence without refund in the event of serious breach of these terms, in particular file redistribution or watermark removal.

11. Warranty and liability

The Licensor indemnifies the Licensee against third-party claims based on copyright ownership in the Images, up to the amount actually paid by the Licensee for the licence concerned. This warranty does not apply to editorial-only Images used outside their scope, nor to uses breaching clause 7.

12. Changes to these terms

The Licensor may amend these terms. The version applicable to a given Image is the one in force on the day it was downloaded. The full text of that version is archived and supplied to the Licensee with each licence issued.

13. Governing law

These terms are governed by French law. Failing amicable settlement, any dispute falls within the jurisdiction of the courts of Saint-Denis, Réunion. Questions: contact@photosreunion.re.
